Heppner and Trinidad: Old Rules for New Technology
Rex Miller II and Graham Christian, attorneys in the Vorys Columbus office and members of the firm’s intellectual property group, published an article in the Summer 2026 issue of the Columbus Bar Association’s Lawyers Quarterly magazine, titled “Heppner and Trinidad: Old Rules for New Technology.”
The article focuses on recent federal district court decisions that demonstrate “old rules continue to apply to new technology,” specifically AI. Miller and Graham analyzed both United States v. Heppner, where the defendant sought to claim attorney-client privilege for interactions with Anthropic’s Claude assistant, as well as Trinidad v. OpenAI Inc., where the plaintiff claimed the company’s ChatGPT had misappropriated alleged trade secrets.
